- Abstract
Historical analysis shows that the violence and depreciation of children and adolescents are as old as the arrival of Europeans in Brazil. In spite of the advances at legislative level, public actions aiming the democratization of the access to school have difficulty admitting adolescents that are in conflict with the law, and making them stay in school. This fact has been corroborated by studies that demonstrate that failure and school dropout are common phenomena in the infracting adolescents' life, and that a significant part of them are out of school. The present text intends to contribute with some thoughts about the relationship of the young author of an infractional acts and school, from the theoretical perspective that sees education as a possibility of liberation, as opposed to relationships of oppression and domination. Our references were Ernani Maria Fiori, Enrique Dussel and Paulo Freire, authors who are concerned about the specificities of the social phenomena in the context of Latin America and the social inclusion of those who are set aside from society.
