- Abstract
The author comments on the decisions of the Court of Appeal and the Divisional Court on the case R. v. Secretary of State for the Home Department, and their implications for defendants convicted of sexual offences who are subject to the notification requirements under the Sexual Offences Act 2003 for an indefinite period with no recourse to any review. One defendant was convicted of rape and sexual activity with a child when aged 11, while another was convicted of indecent assault and sentenced to five years' imprisonment.
