This article explores the challenges and evolution of discovery disputes in the digital age, specifically in the context of electronic discovery (eDiscovery). It emphasizes the importance of proportionality and cooperation among parties to avoid disputes. The article compares the discovery processes in the United States and Canada, highlighting differences in scope, cost recovery, data privacy, and privilege. It also discusses common discovery objections and provides guidance on limiting the scope of requests and addressing issues related to privilege. The article addresses the consequences of spoliation of evidence and provides guidance on data collection, cost management, and collaboration with eDiscovery vendors.
