- Abstract
Objective: this article aims to answer the following research problem: what is the foundation of the essentiality of the right to food for the human person? Therefore, the work is subdivided as follows: a) research methodology; b) presentation of results, c) analysis of discussions of results. Methodology: this is an applied social research of an exploratory and descriptive type with a qualitative approach, with a nominal search process in indexed legal journals qualif ied as A1 and A2, according to the CAPES website. The proposed method is the hypothetical deductive and comparative to investigate and compare the fundamentals of the essentiality of the right to food. Results: it is concluded that, of the 76 (seventy-six) articles located initially, 14 (fourteen) were used as the database of this work, of which 10 (ten) with Qualis A1 stratif ication and 4 (four) with Qualis A2 stratif ication. The analysis of the results was carried out based on two categories: a) Human dignity, life and health as fundamentals of the essentiality of the right to food (11 (eleven) articles) and b) Culture, social relations and the environment as fundamentals of the essentiality of the right to food (6 (six) articles). 3 (three) articles brought arguments f rom both categories. Contributions: the study of the Right to Food is relevant within the f ield of Fundamental Rights, due to its fundamental role in the maintenance of life, health, human dignity, culture, social relations and the environment.
