- Title
Protecting the Party Girl: A New Approach for Evaluating Intoxicated Consent.
- Authors
Goodman, Christine Chambers
- Abstract
This article aims to provide some guidance to U.S. courts and juries in evaluating whether there was valid consent to intercourse when alcohol has been consumed by one or both parties. It gives background on the various conceptions and definitions of consent generally, in the rape context specifically, and then in the context of intoxication. It analyzes studies about the effects of alcohol consumption on the behaviors of men and women. It also describes the sliding-scale proposal and analyzes how this proposed reallocation of risks results in a more just administration of rape.
