- Authors
Fagundes, David
- Abstract
This article examines constitutional protection for government speech in the U.S. through a dual prism that would provide a framework that protects government speech. In Part I, the author outlines the state of precedent on the constitutional status of government speech. In Part II, he looks to constitutional text and history to determine what, if any, insight these sources can offer on this problem. In Part III, the author considers three approaches to the First Amendment.
