- Abstract
The article advocates for a modern revitalization of the Gambling Instinct Test which is used to identify a gambling activity. Topics include the three elements of the common law which must be present to consider a game or activity as gambling such as prize, chance and consideration, the difficulty of using these elements to evaluate all forms of gambling, the reason Gambling Instinct Test is a superior doctrine, and the historical application of the test.
