READING STATUTES IN THE COMMON LAW TRADITION.
- Authors
Pojanowski, Jeffrey A.
- Abstract
The article discusses a U.S. common law tradition regarding statutory interpretation in America as of 2015, and it mentions a nonformalism approach to reading statutes, as well as the late legal philosopher Ronald Dworkin's views and the concept of legal realism. The perspectives of classical common lawyers about legislation are examined, as well as artificial reasoning and the attitudes of textualists. Coherence, formality, and common law romanticism are examined.
