- Abstract
Since the United States Supreme Court's 2001 decision in Crawford v. Washington, lower courts and commentators have wrestled with the application of the Sixth Amendment's Confrontation Clause to scientific lab reports. In particular, courts have struggled with whether to permit the prosecution to use autopsy reports in homicide trials if the medical examiner who wrote the report is not available to testify. These reports are often crucial to homicide prosecutions, prompting the concern that their exclusion may function as a statute of limitations on murder.
