- Abstract
Citizenship is a special legal relation of an individual to a particular state, in fact the basic legal relationship between an individual and a state. It grants an individual a specific legal status i.e. the framework of rights and duties. These are basic political, civil, social and economic rights and duties that an individual is granted whether (s)he is in the state or abroad. Emigration changes only the level of enjoyment of rights or citizenship use but not its essence.. Basically, citizenship is a permanent relation between an individual and a state until its cessation in a special procedure. The authors deal with the European Union citizenship issues. They give a survey of why its existence is questionable. Then they deal with the rights of citizens of the Union. Furtheron, they analyze the cases referring to rights of the Union citizens from the practice of the European Court of Justice to finally conclude with the results of their research.
