- Abstract
The article provides a historical account of the Employee Retirement Income Security Act (ERISA) of 1974 whereby the author, an ERISA expert, relates his life experience of teaching ERISA at Benjamin N. Cardozo School of Law in the U.S. According to him, ERISA and its 35-year legislative and administrative evolution reflect the ideology of ERISA, a paternalistic ideology of good intentions. He states that the protective of ERISA underpins legislative and administrative decision that has not been true in the courts. The author also discusses the disclosure of 401(k) investment fees.
