- Abstract
Objective: This work aims to investigate in which way the transnational legal activism, through the system of denunciations of the Inter-American Commission on Human Rights, led to the creation of norms and public policies in Brazil, using as an example the cases Maria da Penha Fernandes vs Brazil and Damião Ximenes Lopes vs Brazil. Methodology: The research undertaken is carried out through a qualitative approach; a case study research, as well as bibliographic, through the review of works and scientific articles, as well as documentary, due to the review of legislative texts and judicial decisions, aiming to extract due depth of understanding about transnational legal activism. Results: Through the studies of the cases Maria da Penha Maia Fernandes and Damião Ximenes Lopes it is concluded that the action of transnational legal activism contributes to positive social changes occurring in the state demanded, such as the elaboration of norms and public policies that protect vulnerable groups against the violations reported in the cases. Contributions: This study brings as a contribution to the academy and to the community the importance of recognizing that the results obtained have the participation of other internal factors, such as the mobilization of other groups with public campaigns of denunciation, the performance of the media in order to pressure the government and shape public opinion, legislative lobby, among others.
