- Abstract
The article analyzes the potential impact of the decision of the U.S. Supreme Court in the case Summers v. Earth Island Institute on future environmental litigation. It examines how the case fits into the standing jurisprudence of the court since the 1980s, with emphasis on the injury-in-fact requirement. Also discussed are the standing criteria for procedural injury claims. In particular, the article considers the effect of the ruling on both environmental litigation and potential litigation strategies.
