- Abstract
The article analyses a court decision related to the uninsured motorist endorsement in New York. Where insured served demand for arbitration on his insurer pursuant to his uninsured motorist endorsement, insurer's allegation that a notice of disclaimer by the other motorist's insurance company was invalid was held to be insufficient to meet insurer's burden of establishing a genuine issue as to whether an uninsured vehicle was involved.
