- Abstract
The article focuses on a court case related to uninsured motorist. Arbitration was stayed pending a determination of the issue of a motor vehicle operator's insurance coverage where letter from insurer's counsel, raising question of uninsured status of the operator, satisfied the burden placed on the insurer, who was seeking to stay arbitration, of establishing the existence of a genuine preliminary issue warranting a hearing.
