- Abstract
The article presents information on a court case related to personal injury action. Where uninsured motorist policy did not state a time limit for filing of demand for arbitration by either insured or insurer, and personal injury suit was filed within two year statute of limitations for such actions, insured's demand for arbitration of the question as to whether he was "legally entitled" to recover damages from the uninsured motorist was held to be timely, although such demand was filed more than two years after the accident occurred. The court found that the insured was "legally entitled" to recover damages from the uninsured motorist since the suit against the motorist was filed within the required two year statute of limitations.
