- Abstract
The article focuses on the decision of a U.S. court, given in the year 1966, in the lawsuit Thompson v. International Association of Machinists. The court decided that a union breached its duty of fair representation to an employee when it failed to give him notice of the arbitration proceeding pertaining to his discharge, while aware that no other witnesses would testify on his behalf. Under the circumstances, his absence left the union inadequately prepared for a hearing. Moreover, the union neglected to make a transcript of the proceeding as was required by the contract.
