The article discusses the doctrine of joint and several liability which is a creature of the common law. The term joint refers to a procedural device that allowed defendants to be joined in a single lawsuit. According to U.S. state supreme courts, joint and several liability should be retained rather than be replaced by proportionate several liability under-responsibility liability regimes.
