The article examines the scope and application of the discretion of the appellate court in creating instructions on remand in a civil appeal from a final judgment and how lawyers should advocate for a certain remand instruction in Florida. Also cited are the ruling by the Second District Court of Appeal in the case 'Tracey v. Wells Fargo Bank, N.A., and the remand instructions in some civil and foreclosure cases in the state.
