The article offers information on the enactment and implementation of the Foreign Corrupt Practices Act (FCPA) in 1977 by the U.S. Congress, whose provisions abide unlawful business practices of the U.S. companies. It discusses the terms "foreign official" and "instrumentality" as used in the FCPA under the analysis of the court cases U.S. v. Aguilar and U.S. v. Carson.
