- Abstract
The article discusses Alabama Court of Appeals' decision in the case "McQuirter v. State," which figures prominently in many criminal law casebooks. Topics discussed include the standard account set by McQuirter to emphasize the role race played in the case; evolving law of attempts that gave judges and juries increased opportunities for racial discrimination; and ways in which American criminal law shifted from the pattern of manifest criminality to the pattern of subjective criminality.
