- Abstract
This article provides an overview of recent court decisions related to valuation, financial forensics, and expert witnessing. It highlights a specific case, Arrowsmith v. First United Methodist Church, which involved the recovery of charitable donations made by a shareholder in a healthcare laboratory. The court ruled that the trustee could recover a portion of the donations as they were traced back to funds received from the laboratory, rejecting arguments that the donations provided intangible value or were spent on community programs. The article also discusses the case of Marshack v. Hyundai Steel, which involved the recovery of avoidable transfers and tracing of fraudulent transfers. In this case, the court found a lack of evidence to support the trustee's claims against Hyundai.
