- Abstract
The article explores the ethical duties of labor and employment lawyers in light of the algorithmic employee selection practices of corporations in the U.S. It discusses the professional responsibility rules applicable to hiring technologies, namely, the duty of attorney competency and of client advisement. It examines such technologies such as applicant screening tools and psychometric assessments. Also noted are ways to use reasonable care in representing employers who employ such technology.
