- Abstract
The article focuses on the use of lethal force to defend property in South Africa. According to the 2003 ISS National Victims of Crime survey, South Africans are much more fearful of crime nowadays than they were in 1988. In the field of common law, the controlling principle on the right to use force to defend one's self or one's property is proportionality however; the courts still weigh up the interests protected by the defensive act against the interests infringed by the unlawful attack. Furthermore, the changes under the new constitution of South Africa are also discussed.
