- Title
Boiling The Judicial Frog.
- Authors
Nelson, James C.
- Abstract
The article discusses the increasing efforts by right-wing politicians and legislatures to assert political power over state judicial branches in the United States. These attacks on state courts have been incremental, with the goal of bringing judges and the courts under the control of the legislative and executive branches of government. The article specifically focuses on the attacks on Montana's judicial branch, including the formation of a Senate Select Committee on Judicial Oversight and Reform. The author argues that the judicial branch serves as a co-equal check and balance on the political branches, and these attempts to oversee and reform the judiciary threaten its independence.
