- Title
Admissibility of Evidence of Co-defendant’s Bad Character under s. 101(1)(e) Criminal Justice Act 2003.
- Authors
Stockdale, Michael; O’Cain, Andrea
- Abstract
The article discusses a court case where the judge admitted evidence of the defendant P's 3 convictions as evidence of his propensity to be untruthful and held that the matters in issue between defendants P and M were factual disputes about their respective locations in the guest house. The Court of Appeals dismissed P's assertion that the convictions cannot be relevant to credibility and that the judge had relied on a common law decision.
