- Abstract
The article examines the debate over whether the First Amendment conflicts with the Hate Crime Prevention Act (HCPA) in the U.S. It explains the historical developments of HCPA from its roots in the Civil Rights Era to the legislative battle over the bill in October 2009. It also discusses the merits and flaws between HCPA, which is being argued that stifles freedom of speech, and First Amendment, which prohibit the Congress from making any that abridge freedom of speech.
