- Title
WHEN DOES SOME FEDERAL INTEREST REQUIRE A DIFFERENT RESULT?: AN ESSAY ON THE USE AND MISUSE OF BUTNER V. UNITED STATES.
- Authors
Moringiello, Juliet M.
- Abstract
An essay is presented surveying notable uses and misuses of the Court's statement about property in the case Butner v. United States to illustrate that courts applying the case have obscured its proper role. It further surveys the property rights of secured creditors in bankruptcy and how they are altered by bankruptcy law. It also reviews cases in which courts appropriately balanced state and federal law in determining a secured creditor's bankruptcy rights.
