- Abstract
An essay analyzing the Cunningham opinion and the Claiborne-Rita briefs on federal sentencing guidelines is presented. According to the author, from the case Cunningham v. California and the pending cases of Claiborne v. United States and Rita v. United States, it is clear that all sides have adopted indefensible positions and no one has offered the Court help in creating a sensible rule to resolve the cases.
