- Abstract
The article discusses a court case of El Paso Corp. v. Comision Ejecutiva Hidroelectrica del Rio Lempa (CEL) under the Fifth Circuit in Geneva, Switzerland. It examines the case conducted under the United Nations Commission on International Trade Law (UNCITRAL) Arbitration Rules which involves a private arbitration. The court ruled that the appeal rejecting the discovery application under U.S. Code Section 1782 of Title 28 is not rendered moot especially if the evidence is closed under UNCITRAL.
