Missouri: Unilateral Right to Arbitrate.
- Abstract
The article reports that the Missouri Supreme Court issued a decision that enforced an arbitration clause in a home construction contract that gave the builder the exclusive right to initiate arbitration. Two important factors informed the court's decision. First the court determined that the agreement was not an adhesion contract. Second the court determined that because there was consideration for the overall contract, there was no need to have consideration for the arbitration clause itself.
