- Abstract
The article offers information on the development of a public policy for protection of rights of persons with mental retardation in North Carolina. It analyzes various basic constitutional protections available under the Constitution of North Carolina regarding protection of liberty interests of the criminal defendants'. It discusses the U.S. Supreme Court case Jackson v. Indiana in which the court held that confinement of persons with mental retardation is unconstitutional.
