- Abstract
The article discusses a British Divisional Court's case related to trespassing into a house, wherein the court ruled that the act cannot be considered under the criminal law of England and Wales to deter offences against the person in householder. It states that the case arose from decision of the Crown Prosecution Service of Great Britain not to prosecute the trespasser, and cites implications of Article 2 of the European Convention on Human Rights, and notes use of disproportionate force.
