- Abstract
The article focuses on the case of NOS Communications Inc. and Affinity Network vs. their consumers in the U.S. The plaintiffs argued that the charges, practices and regulations in defendants tariffs were unjust and unreasonable because the terms were not clear and do not explicitly explained the rates and regulation. The court determined the U.S. Federal Communications Act's (FCA) does not preempt the state law claims in the area of interstate telecommunications and "Truth-in-Billing" regulations cannot be applied retroactively.
