- Title
ARBITRATION AS AN AID IN THE ENFORCEMENT OF THE ANTITRUST LAWS.
- Authors
HAYES, JAMES V.
- Abstract
The article focuses on the use of arbitration for enforcement of decrees given under the antitrust laws in the U.S. It states that the difficulties in enforcement of antitrust decrees are difficult due to various reasons, including problems related to litigation of contempt of court proceedings, problems related to treble damage suits in consent decrees, and unclear enforcement proceedings. According to the article, in such antitrust cases, an arbitrator can help to judge the conformity of defendants with the antitrust decree.
