- Abstract
The Republic of Macedonia, with the Novel of the Criminal Code (CC) of 2004 and its subsequent amendments, as well as the Law on Criminal Procedure, and most recently with the adoption of the new LCP in 2010, introduced all the necessary measures for enabling the search, identification, and the confiscation of criminal property, value confiscation, as well as enabled the use and perfecting of the use of special investigative techniques as an effective procedural legal tool for searching, identifying, finding and seizing criminal prisons his or illegally acquired property and proceeds. The confiscation provisions, for the first time, have been introduced into the penal legislation as a result of meeting the international obligations of Macedonia with the ratification of the Vienna Convention, the purpose of which is to deprive persons involved in crime from proceeds from criminal activity and, more importantly, their initiative for future criminal activities is eliminated, as well as the obligation for states to introduce measures to enable the competent authorities to take such a seizure. The Council of Europe Convention against Money Laundering (Strasbourg Convention) of 1990, which extends the confiscation of all crimes as an effective and modern method of an international plan in the fight against serious crimes, has also been ratified.
