- Abstract
The article focuses on core allegations against discovery which raise rivals' costs so that they can increase the value of settlement. It mentions parties use discovery to go on fishing expeditions and information asymmetry is not a sufficient reason to allow discovery. It also mentions evidence used to criticize discovery is based on surveys of lawyers either overseeing or litigating cases and electronic filing, courts and litigants will incur few costs from this change.
