The article discusses the court case Krawiec v. Manly wherein the Supreme Court of North Carolina considered the proper standard required for a claim of trade secret misappropriation to survive a motion to dismiss for failure to state a claim on which relief can be granted. It contends that the court applied the wrong pleading standard when it ruled on the sufficiency of a complaint for the purpose of overcoming a motion to dismiss.
