- Abstract
The article discusses doctrinal dilemma created by failed exactions which are regulatory conditions on property development that government agencies contemplate but that never finalized or enforced. It discusses the U.S. Supreme Court cases Nollan v. California Coastal Commission and Dolan v. City of Tigard in this context. It describes the existing case law on failed exactions and offers legal means to check extortionate threats by government agencies.
