- Abstract
The article discusses the application of equitable and constructive trust principles to pension benefits. The Alberta Court of Queen's Bench issued a decision on the Holowa Estate, involving a dispute over the payment of a death benefit. James Holowa paid into the Local Authorities Pension Plan as an employee of the city of Calgary for 38 years. The court ordered the plan, the payment of the benefit to Judith Hanrahan, his wife since December 29, 1998, in accordance with its rules.
