- Abstract
The author discusses the Great Britain Supreme Court case R (Lumba) vs. Secretary of State for the Home Department which involved two convicted foreign national criminals who were detained pending removal from the country. The court found the Secretary of State liable for unlawful detention and false imprisonment claims. The author contends that punitive damages do not form part of the Human Rights Court's practice and thus vindicatory damages would unlikely be accepted in Europe.
