- Abstract
The article presents information on the history of industrial practices regarding music sampling in the U.S. and enumerates how sampling works, the technology involved, and why it is valuable to musical artists. It highlights the common law that affects sampling and analyzes the legal difficulties arising from the way copyright law of the U.S. treats music sampling. It suggests a comprehensive scheme which is intended to balance the interests of samplers and copyright holders.
