- Abstract
The article discusses the reviewability by Utah's appellate courts of decisions by procurement units to lift stays of the procurement process of contract negotiations and awards during the pendency of bid protests. Topics covered include the separation of powers and due process principles and the purposes behind the Utah Procurement Code, the courts' role in reviewing stay decisions and the role of the protest process in realizing the code's purposes of transparency, fairness and competition.
