- Abstract
The article presents a study in the foundations of American constitutionalism, the system that guarantee continuation of democratic government, involving habeas corpus, due process and the suspension clause. It states that the framers preferred to adopt a written Constitution in order to restrain democratic government within a set of outlined boundaries. It mentions that the suspension clause must be viewed as limited by the due process clause in order to preserve the constitution.
