- Abstract
The article "The Black Swan in Negotiations" discusses various approaches to preparing for disputes in court. In Australia, pre-action procedures have been tested for construction and medical liability cases, while in Singapore, pre-action protocols for medical liability cases were introduced as early as 2006. In the United States, there is the procedure of Early Neutral Evaluation, where a neutral third party accompanies the dispute. The article raises the question of whether similar procedures would be useful in Germany and whether mediation should play a larger role. It emphasizes that observation and "deep listening" are key skills for negotiating more effectively and efficiently. The author recommends training this expanded perception in every negotiation.
