- Abstract
Most negotiators understand the value of evaluating their BATNA (best alternative to a negotiated agreement), BATNA analysis is also useful in the practices of superior bargaining position in Antimonopoly act of Japan. The main results can be summarized as follows. In contrast to the well-known notion that abuse of a superior bargaining position does not require that a party have market power, recent cases of abuse of superior bargaining position have shown that the proof of superior bargaining position has required the possession of market power or existence of market dominance.
