- Abstract
The article examines the role of cognitive fatigue on witness deposition performance in nuclear settlements. Topics covered include how the take a break every hour philosophy used by most attorneys proved to be a gross strategic and neuropsychological mistake that leaves the witness highly vulnerable to cognitive fatigue, and the association of cognitive fatigue to poor testimony that unnecessarily harms the defense's case, both strategically and economically.
