- Abstract
The article discusses the decision of the U.S. Court of Appeals for the Sixth Circuit in the 2015 case Rochow v. Life Insurance Co. of North America (LINA). The plaintiff, Daniel Rochow, president of Arthur J. Gallagher & Co., filed the case after the insurer denied his long-term disability benefit claim on the ground that his employer ended before his disability began. Rochow claimed that LINA violated the Employment Retirement Income security Act (ERISA) after it denied his benefits.
