- Abstract
The article presents information on the Massachusetts declaration of rights that guaranteed the rights to counsel for every criminal defendant. A comparison is made with the Bill of Rights of the U.S. Constitution. A focus is on the need of prohibition of police-initiated interrogations and the concept of judicial federalism. The U.S. Supreme Court decisions of Michigan v. Jackson and the overruling of Montejo v. Louisiana is also discussed.
