THE POLITICAL QUESTION DOCTRINE IN STATE CONSTITUTIONAL LAW.
- Authors
Rodriguez, Daniel B.
- Abstract
An essay is presented on the role of the political question doctrine in state constitutional law in America as of April 2013, focusing on nonjusticiability doctrines, mootness, and the U.S. Supreme Court's rulings in cases such as Colegrove v. Green. Then-U.S. Supreme Court Justice Felix Frankfurter is addressed, along with the ripeness legal principle. A "case or controversy" requirement in Article III of the U.S. Constitution is examined, along with the case Marbury v. Madison.
